OFFICE OF THE Umpire No. E-46 JANUARY 13, 1947
Claimed Violation Of Paragraph 63 (b).
GRIEVANCE: Pontiac Motor DivisionCase E-1 "I protest being transferred out of line of seniority." United Automobile Workers of AmericaC.I.O.Local 653
UMPIRE DECESION The grievance is dismissed. (Entire Decision should be read)
In the Matter of: United Automobile Workers of AmericaC.I.O.Local 653 and General Motors CorporationPontiac MotorCase E-1 This grievance presents the claim of an employee, who was working in the Central Stores Department of the Pontiac Motor Division, that Management violated his rights under Paragraph 63 (b) by transferring him over his Decision: Under the principles established in Umpire Decision E-44, this grievance must be held to be without merit. As the Umpire made clear in that decision, Paragraph 63 (b) gives an employee no right to refuse a transfer. This is true even within a department, though in such a case an employee would carry with him the right to apply for retransfer to his former classification should future openings in that classification arise. It is all the more true of transfers across departmental lines, which are completely unaffected by Paragraph 63 (b).
Decision: The grievance is dismissed.
